Its no wonder that we struggle with Internet privacy. Privacy laws are steeped in Fourth and First Amendment tradition which originated with physical protections: the privacy of the home and the person cannot be violated.
Understand, current legislative efforts should not compromise the Constitution. Instead, they must acknowledge the changes to “physical” life in the 21st Century. National boundaries and walls between countries and culturies have come down and are continuing to crumble.
We need a new “Privacy Paradigm” that accounts for instant global communication and its requirement of openness to work effectively.
